Requirement
107 — Amendment to Regulation (EU) 2018/858
Consideration of AI Act Chapter III Section 2 requirements in delegated acts under Regulation 2018/858
Description
When the Commission adopts delegated acts pursuant to Article 5(3) of Regulation (EU) 2018/858 concerning Artificial Intelligence systems that are safety components (within the meaning of Regulation (EU) 2024/1689), the Commission shall take into account the requirements set out in Chapter III, Section 2 of Regulation (EU) 2024/1689 (the high-risk AI system requirements, such as risk management, data governance, technical documentation, record-keeping, transparency, human oversight, and accuracy/robustness/cybersecurity requirements). This obligation is directed at the European Commission as the legislative/delegated act-adopting authority, not at providers or deployers of AI systems, but it indirectly shapes the regulatory framework applicable to AI systems that are safety components of vehicles under type-approval legislation.
