Risk Management
82 — Compliant AI systems which present a risk
Comply with Market Surveillance Authority's Risk Mitigation Order
Description
When a market surveillance authority finds that a compliant high-risk AI system nevertheless presents a risk to health, safety, fundamental rights, or public interest, the relevant operator (provider or other operator) must take all appropriate measures to ensure the AI system no longer presents that risk when placed on the market or put into service, within the timeline prescribed by the authority. This follows an evaluation under Article 79 and consultation with the national public authority under Article 77(1).
