EU-AIA-94-01
Requirement
94 — Procedural rights of economic operators of the general-purpose AI model
Application of Regulation 2019/1020 Article 18 procedural rights to GPAI providers
Description
Authorities enforcing this Regulation against providers of general-purpose AI models must apply Article 18 of Regulation (EU) 2019/1020 mutatis mutandis, meaning they must afford these providers the same procedural rights (e.g., right to be heard, right to be informed of the grounds for an intended measure, right to make submissions before adverse decisions) that apply to economic operators under market surveillance procedures. This does not impose a direct compliance obligation on providers themselves, but rather establishes a procedural safeguard that must be respected by supervisory/market surveillance authorities when taking action against GPAI model providers. It operates without prejudice to other more specific procedural rights granted elsewhere in this Regulation.
